Summary: These Terms bind Marc Garelick and any visitor or customer.

Detail:

Summary: You protect the login. Anything under it is treated as yours.

Detail:

  • Login credentials must remain confidential.
  • Activity under your account is treated as your own.
  • Report unauthorized access immediately.

Card 04 — Order Formation

Summary: A submitted order is your offer. Our confirmation email is our acceptance.

Detail:

  • Contract exists only from the moment we email the order confirmation.
  • Before confirmation, we may decline an order for:
    • stock unavailability
    • a material error in price or description
    • suspected fraud
    • breach of these Terms
  • Where a paid order is cancelled by us, a full refund is issued to the original payment method.

Card 05 — Pricing

Summary: USD. The checkout price is the price we honor for that order.

Detail:

  • All prices stated in U.S. dollars.
  • Prices may change without notice.
  • Manifestly incorrect prices (typos, misplaced decimals) may be cancelled with a full refund rather than fulfilled at the wrong price.

Card 06 — Payment

Summary: Due at checkout via the methods offered.

Detail:

  • Submitting payment information constitutes confirmation that you're authorized to use the payment method.

Card 07 — Shipping & Returns

Summary: Two additional policies apply to every order.

Detail:

  • Shipping — governed by the Shipping Policy.
  • Returns and refunds — governed by the Return and Refund Policy.
  • Both are part of these Terms.

Card 08 — Product Descriptions

Summary: Accurate to the best of our ability; small variation is normal.

Detail:

  • Photography, measurements, and materials described accurately.
  • Small variations in color, texture, or fit — from screen calibration or natural materials — are not defects.

Card 09 — Intellectual Property

Summary: All content is ours or licensed to us.

Detail:

  • Protected content includes text, photography, illustrations, graphic design, video, source code, layout, and the "Marc Garelick" name and identifying marks.
  • U.S. copyright and trademark law applies.
  • Permitted: browsing, sharing links, saving pages for personal reference.
  • Requires written consent: commercial reproduction, use of brand assets in another business, scraping or mirroring, modification or redistribution.

Card 10 — Acceptable Use

Summary: No illegal, malicious, or automated abuse of the site.

Detail:

  • Do not use the site unlawfully or fraudulently.
  • Do not compromise its security or the security of its users.
  • Do not transmit malware, viruses, or spam.
  • Do not use bots or scrapers without written permission.
  • Do not impersonate any person.
  • Breach may end access without notice.

Summary: "As is" and "as available"; consumer rights unaffected.

  • The site and products are provided "as is" and "as available."
  • To the fullest extent U.S. law permits, we disclaim implied warranties (merchantability, fitness for purpose, non-infringement).
  • Your statutory consumer rights remain unaffected.

Summary: Direct claims capped; indirect losses excluded.

  • Direct claim: capped at the amount you paid for the product at issue.
  • Indirect losses: not our responsibility. Includes lost profits, lost data, lost time, hypothetical damages.

Summary: We may end access at any time for a breach.

Detail: No prior notice is required.

Summary: California law, Newport Beach jurisdiction.

Detail:

  • Governed by U.S. federal law and the laws of the State of California, without regard to conflict-of-law principles.
  • Any legal proceeding must be brought in the appropriate state or federal courts of Orange County, California.
